Rules concerning unprofessional conduct are offered by the New York State Board of Regents. Attention is directed to: general provisions for all professions, health professions, and design professions (e.g., architecture and engineering), as well as special provisions for: the medical profession, the dentistry and dental hygiene professions, the veterinary medicine profession, the pharmacy profession, the optometry profession, the profession of ophthalmic dispensing, the accounting profession, certified shorthand reporting profession, the psychology profession, and the massage profession. Unprofessional conduct in the practice of any licensed or certified profession includes: (1) willful or grossly negligent failure to comply with provisions of federal, state, or local laws, or rules governing the practice of the profession; (2) exercising undue influence on the patient or client, including the promotion of sale of services, goods, or drugs in order to exploit the patient/client; (3) conduct in the practice of a profession that shows evidence of moral unfitness to practice the profession; or (4) willfully making or filing a false report.
