In this update, the author notes the passage of the "Second Chance Act" by Congress--signed into law by the President on April 9, 2008. Programs created in law may or may not be immediately funded and implemented. The criminal justice community will be watching the appropriation process with interest to learn what Second Chance programs will be implemented and when. Regardless of the short term outcome of these efforts to secure funding, the enactment of the Act may be considered a milestone in a process of turning from punishment and incapacitation towards rehabilitation as the underlying philosophy of the American prison. Furthermore, the author states that Congress has also been at work on a reauthorization of the Higher Education Act, a process that may well lead to significant changes in the grant program administered in the Office of Correctional Education titled the Grants to States for Workplace and Community Transition Training for Incarcerated Youth Offenders Program. CEA has kindly reserved a workshop slot at the Denver conference which will provide an opportunity for a full update on any changes to the Incarcerated Youth Offender Program.
