This paper explores the minimum competency testing clarification hearing in order to better understand the strengths and weaknesses of adversary evaluation as a vehicle for clarifying matters of public policy interest. It is widely claimed that public schools do not prepare students for academic success or for success in the workplace and that public investment in nonpublic schooling would remedy these problems. These conclusions are analyzed with reference to international studies of student achievement, and their validity is challenged. (SLD)
