First amendment challenges to the use of mandatory student fees for abortion services have not reached federal courts, and the only pertinent state decision upheld the mandatory fee system. While institutions have the right to define themselves as they wish, if they want to be accredited they must meet the standard of free inquiry that higher education demands.
